The HIPAA Breach Notification Rule, requires HIPAA covered organizations and their employees to provide notification following a breach of unsecured protected health information. These requirements are as follows: Individual Notice: Covered entities must notify affected individuals following discovery of a breach of unsecured PHI. In instances where the breach affects more than 500 residents of a State or jurisdiction, notice must be provided to prominent local media. (1) HIPAA Breach Notification Rule: Following a breach of unsecured PHI, CEs must notify the affected individual(s) and the Secretary of Health and Human Services (HHS). Not all security incidents are breaches, and not all breaches are reportable breaches. ![]() The HIPAA Breach Notification Rule requires that, in the event of a breach of unsecured PHI, notification of the breach is communicated to affected individuals, the U.S. HIPAA, the HITECH Act and now changes under the Omnibus Rule require covered entities and business associates to report certain breaches. The HIPAA Security Rule specifies safeguards to protect the confidentiality, integrity, and availability of electronic protected health information (ePHI).
